1. Acceptance of Terms

By creating an account or using Party Book (available at ourpartybook.com), you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use our platform.

These terms apply to all users of Party Book, including organization administrators, event organizers, group members, and ticket purchasers. We may update these terms from time to time. Continued use of Party Book after an update constitutes acceptance of the revised terms.

2. Description of Service

Party Book is an online platform that enables community organizations — including school PTAs, nonprofits, sports teams, and neighborhood associations — to run event-based fundraisers. Organizations create an account, invite members, and host a catalog of events. Community members browse the catalog and purchase tickets to attend those events.

Party Book is a technology platform and marketplace. We are not the organizer of any event listed on our platform. Event organizers are independent parties who are solely responsible for planning, hosting, and delivering their events. Party Book does not endorse, sponsor, or assume responsibility for any event listed on the platform.

3. Account Registration

You must be at least 13 years old to create an account on Party Book. By registering, you represent that you meet this age requirement.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. If you believe your account has been compromised, contact us immediately at support@ourpartybook.com.

You agree to provide accurate, current, and complete information when creating your account. Party Book reserves the right to suspend or terminate accounts that contain false or misleading information.

4. Event Organizer Responsibilities

If you create or manage events on Party Book, you take on the following responsibilities:

  • You are solely responsible for planning, organizing, and delivering your event as described. This includes all logistics, venue arrangements, food, equipment, permits, and any other requirements.
  • You must accurately describe your event, including the date, time, location, ticket price, capacity, and what attendees can expect. Misleading descriptions are prohibited.
  • You are responsible for setting and communicating your refund policy to attendees before they purchase tickets. Party Book does not dictate refund policies and is not liable for disputes between organizers and attendees.
  • You must comply with all applicable laws and regulations, including local event permitting requirements, food handling regulations, and any licensing requirements relevant to your event type.
  • To receive payments, you must connect a valid Stripe account to your organization. You agree to Stripe's terms of service in addition to ours.

If you cancel an event, you are responsible for promptly notifying ticket holders and issuing refunds in accordance with your stated refund policy. Party Book will facilitate refunds through Stripe, but the obligation to refund attendees rests with you.

5. Ticket Purchases and Refunds

When you purchase a ticket through Party Book, you are entering into a transaction with the event organizer, not with Party Book. Party Book processes the payment on behalf of the organizer using Stripe Connect.

Ticket sales are generally final unless the event organizer's refund policy states otherwise, or unless the event is cancelled. Each event page displays the organizer's refund policy — please review it before completing a purchase.

If an event is cancelled by the organizer, Party Book will initiate a refund of the ticket price to your original payment method. Payment processing fees charged by Stripe may not be refunded, as this is subject to Stripe's refund policies.

Party Book is not responsible for the quality, safety, legality, or delivery of events. If you have a dispute with an event organizer, we encourage you to resolve it directly. We may, at our discretion, assist in facilitating resolution.

6. Fees and Payments

Party Book charges a platform fee on each ticket sold. The fee structure is:

  • Tickets priced $5.00 or under: $0.25 per ticket
  • Tickets priced over $5.00: $0.50 + 1.5% of the ticket price, with a maximum of $8.00 per ticket

In addition to the Party Book platform fee, Stripe charges a payment processing fee of 2.9% + $0.30 per transaction. This fee is standard across Stripe's platform and is not set by Party Book.

There are no monthly fees, setup fees, or subscription charges to use Party Book. Fees are only charged when tickets are sold.

Funds from ticket sales flow directly to the organization's connected Stripe account, minus applicable fees. Party Book does not hold funds on behalf of organizers. Organizations are responsible for their own tax obligations, including reporting ticket revenue appropriately.

7. User Content

Party Book allows users to submit content, including event descriptions, images, and other materials (“User Content”). You retain ownership of your User Content.

By submitting User Content to Party Book, you grant us a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute that content on our platform for the purpose of operating and promoting Party Book and your events. This license ends when you remove the content or delete your account.

You represent that you own or have the necessary rights to any content you submit, and that your content does not infringe the intellectual property rights, privacy rights, or other rights of any third party. You are solely responsible for the accuracy and legality of your User Content.

Party Book reserves the right to remove User Content that violates these terms or that we determine, in our sole discretion, to be inappropriate, harmful, or in violation of applicable law.

8. Prohibited Activities

You agree not to use Party Book for any of the following:

  • Creating, listing, or promoting events that involve illegal activity, including the sale of illegal goods or services, or events that require unlicensed activities
  • Fraud or misrepresentation — including creating fake events, providing false event details, or collecting payments for events you do not intend to hold
  • Harassment, threats, or intimidation of other users, attendees, or Party Book staff
  • Uploading or distributing malware, viruses, or any code designed to damage or interfere with Party Book or other users' systems
  • Scraping, crawling, or otherwise extracting data from Party Book without our express written permission
  • Circumventing or attempting to circumvent our fee structure or payment processing
  • Impersonating any person, organization, or entity, including Party Book itself
  • Using the platform to violate any applicable local, state, national, or international law

Violations may result in immediate suspension or termination of your account and, where appropriate, referral to law enforcement.

9. Intellectual Property

Party Book and its original content, features, and functionality are owned by Party Book and are protected by applicable copyright, trademark, and other intellectual property laws. The Party Book name, logo, and any associated marks are trademarks of Party Book.

You may not use Party Book's name, logo, or branding without our express prior written consent. You may not copy, reproduce, modify, or create derivative works of the Party Book platform or its content.

10. Limitation of Liability

Party Book provides its platform on an “as is” and “as available” basis. We make no warranties, express or implied, about the reliability, accuracy, or availability of the platform.

To the fullest extent permitted by law, Party Book shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to:

  • Loss of revenue, profits, or data
  • Failure of an event organizer to deliver an event as described
  • Any conduct or content submitted by other users
  • Unauthorized access to or alteration of your data
  • Service interruptions or technical failures

In no event shall Party Book's total liability to you exceed the amount of platform fees paid by you (as an organizer) or to you (as an attendee) in the twelve months preceding the claim. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so these limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Party Book and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in any way connected with:

  • Your use of Party Book or violation of these Terms
  • Any event you organize through the platform
  • Your User Content
  • Your violation of any third-party rights

12. Termination

You may delete your account at any time by contacting us at support@ourpartybook.com or through your account settings.

Party Book reserves the right to suspend or terminate your account at any time, with or without notice, for any of the following reasons:

  • Violation of these Terms of Service
  • Conduct that we determine, in our sole discretion, to be harmful to other users, Party Book, or third parties
  • Extended periods of account inactivity
  • Legal requirements or requests from law enforcement

Upon termination, your right to access and use Party Book ceases immediately. Provisions of these Terms that by their nature should survive termination — including intellectual property rights, disclaimers, and limitations of liability — will survive.

13. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in California.

If you are located outside the United States, you agree that your use of Party Book is subject to these Terms regardless of local laws, to the extent permitted by applicable law.

14. Changes to Terms

We may update these Terms of Service from time to time to reflect changes to our platform, business practices, or legal requirements. When we make material changes, we will update the “Last updated” date at the top of this page.

We will make reasonable efforts to notify users of significant changes via email or a notice within the platform. Your continued use of Party Book after any changes take effect constitutes your acceptance of the revised Terms.
